TERMS AND CONDITIONS

You are welcome to KiniScore (hereinafter referred to as “the tool”), The tool is owned and operated by Abiodun Tope Ltd, a private limited liability company registered under the laws of the Federal Republic of Nigeria, and corporate office at Opebi, Lagos State, Nigeria (hereinafter referred to as “the company”). We are a data collection and sports statistics company that collates information on footballers in Africa, and provide access to players, scouts, agents, etc to such materials, through the Kiniscore.

  1. Terminology

1.1 The following terminology applies to these Terms and Conditions: 

  1. "You" and "Your" refers to you, the person accessing this tool and accepting the Company's terms and conditions.

  2. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company – Abiodun Tope Ltd

  3. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore referring to the same entity.

 

  1. General Terms

    1. Please carefully read all these terms before using KiniScore,.

    2. By accessing, using and/or registering on KiniScore, we assume that you accept these terms and conditions in full. If you do not accept any part or all of the terms and conditions stated on this page, please do not continue to use this tool.

    3. We reserve the right, and may need, to update these Terms from time to time by updating this page. By using this tool after we have made such updates, you agree to be bound by the revised Terms. As such, we would encourage you to come back and review it from time to time.

    4. Where we believe that you have violated any of these terms, we reserve the right to deny you access, in addition to any other legal remedy available to us.

    1. The privacy of our users is important to us. It is our policy to ensure that they are protected hence our commitment to the security of their personal information. Please see the KiniScores Privacy Policy which describes the types of data we collect from users and how we utilize such data.

    1. Unless otherwise stated, all the material contained in this tool, including, but not limited to text, images, illustrations, audio clips, and video clips, is protected by copyright, trademarks, and other intellectual property rights which are owned and controlled by our company.

    2. Every material on this tool is provided to you by our company solely for personal, non-commercial use. As such, you agree that such material may not be copied, reproduced, republished, uploaded, posted, sold, rented, sub-licensed, transmitted, or distributed in any way, including by e-mail or other electronic means, without our prior written consent or of other parties (where applicable) who have licensed the use to us.

    3. Any modification or use of the materials on any website, computer software, or networked computer environment, or use of the materials for any purpose other than personal, non-commercial use without our prior written consent, is a violation of the copyrights, trademarks, and other proprietary rights, and is strictly prohibited.

 

  1. Disclaimer of Liability and Warranties 

    1. Whilst we endeavour to ensure that the materials on KiniScore are correct, we do not warrant its completeness or accuracy; nor do we commit to ensuring that the tool remains available or that the material on the tool is kept up to date. 

    2. Neither our company, nor its affiliated or related entities, nor any person involved in the creation, production, and distribution of the tool warrants that the functions contained in the materials will be uninterrupted or error-free, that defects will be corrected, or that our company or the server that makes them available are free of viruses or other harmful components. The material that you access on Kiniscores is provided solely for football scouting and football purposes. Our company does not warrant nor make any representations regarding the use or the results of the use of the materials on the tool in terms of their correctness, accuracy, reliability, or otherwise.

    3. You expressly agree that, except for death and personal injury arising as a consequence of our negligence, neither we nor any of our employees, or agents, nor any person or entity involved in the creation, production, and distribution of the tool are responsible or liable to any person or entity whatsoever for any loss or damage whatsoever resulting from the use of this tool. By way of example, and without limiting the generality of the foregoing, our company and/or related persons and entities shall not be responsible or liable for any claim or damage arising from failure of performance, error, omission, interruption, deletion, defect, delay in operation, computer virus, theft, destruction, unauthorised access to or the reliance upon or use of data, information, opinions or other materials contained in this tool.

    1. Kiniscores may contain links to the websites of third parties not owned by our company (“Linked Sites”). As such, the Linked Sites are merely for your convenience, and you access them at your own risk. Our company is not responsible for the content of the Linked Sites, whether or not our company is affiliated with sponsors of the sites. The Linked Sites are not endorsed by our company in any way whatsoever.

  2. Severability

    1. Where any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable by applicable law, such provision shall be deemed to be severed from these Terms and Conditions and, shall not affect the validity and enforceability of other provisions.

 

  1. Governing Law

    1. If you are domicile in Nigeria , these Terms and Conditions shall be governed by, construed and enforced in accordance with the laws of Nigeria. Any action you, any third party or our company brings to enforce these Terms in connection with any matters related to Kiniscores shall be subject to the exclusive jurisdiction of any competent Nigerian Court.

    2. If you are domiciled outside Nigeria, these Terms and Conditions shall be governed by, construed and enforced in accordance with swiss laws, and any action you, any third party or our company brings to enforce these Terms in connection with any matters related to Kiniscores shall be subject to the exclusive jurisdiction of the Court of Arbitration for Sport, Lausanne, Switzerland. 

 

  1. Indemnity 

    1. You agree to indemnify our company and/or its officers, directors, employees, agents, distributors and affiliates from and against any and all third party claims, demands, liabilities, costs, or expenses, including reasonable legal fees, resulting from your breach of any of the foregoing agreements.
